GOMOR Rebuttals

A GOMOR stands for General Officer Memorandum of Reprimand and it is the most severe letter of reprimand that can be issued in the Army. The governing authority for GOMORs is Army Regulation (AR) 600-37. A GOMOR is a form of adverse action that is administrative, not criminal in nature. What this means is that if you receive one, there are no criminal implications such as a conviction associated with it. However, a GOMOR can have very serious consequences and if not handled properly can be the beginning of the end of your career. In the Army the most common type of GOMOR is issued for service members who have gotten a DUI. But GOMORs are not limited to that they can be issued for a wide variety of offenses ranging from conduct unbecoming, dereliction of duty, or even sexual assault. GOMORs are often issued for sexual assault when the prosecution cannot prove the case beyond a reasonable doubt at trial. When you receive a GOMOR you will have a chance to respond to it by submitting what are called rebuttal matters. Per the regulation above, you will normally have seven calendar days to submit a response. Reasonable extensions are usually granted and your GOMOR lawyer should request an extension for you. The General Officer who initiates the GOMOR is the same General Officer that will decide whether that GOMOR should be withdrawn and destroyed, locally filed, or permanently filed in your AMHRR. In some cases, because of recent changes to the regulation, permanent filing is not an option and it is imperative that your GOMOR attorney understands to which cases this applies. If your GOMOR is withdrawn and destroyed it is as if it never existed in the first place. If your GOMOR is locally filed, it will remain with your current unit and may not be filed for a period exceeding eighteen months. If it is permanently filed, it will be placed in your AMHRR and will rarely be removed. A permanently filed GOMOR usually means that administrative separation of elimination proceedings will be imminent.
